Family lawyer
in Luxembourg

Divorce, children, maintenance, contact rights

The firm acts in family law in Luxembourg, and in particular in divorce by mutual consent or on the ground of irretrievable breakdown, in judicial separation, and in the division of matrimonial property.

Where children are involved, the firm advises on parental authority, where the child lives, contact and overnight stays, and maintenance.

Where agreement can be reached, it often preserves a workable family balance. Failing that, the file is prepared so that the family judge can rule on the points that remain in dispute.

Situations in which
the firm acts

  • Divorce

The route chosen determines how long the proceedings take, what they cost and the atmosphere in which they unfold. The firm sets out the options before the decision is made.

  • Divorce by mutual consent

This requires complete agreement on the consequences of the separation, both financial and as regards the children. That agreement is recorded in a settlement submitted to the judge.

  • Irretrievable breakdown

Where agreement is not possible, this route allows a divorce without having to prove fault. The firm handles the procedure.

  • Separation

Judicial separation, or arranging separate lives ahead of a divorce: interim measures can be applied for to deal with what is urgent.

  • Where the children live

Where a child lives is decided on the child's interests alone. The firm helps assemble the practical evidence that genuinely informs that assessment.

  • Parental authority

Joint or sole exercise, disagreement over an important decision concerning the child: the firm acts both to head off conflict and to bring it before the judge.

  • Contact and overnight stays

Setting, changing or enforcing the arrangements: these questions are best settled by agreement and, failing that, by the family judge.

  • Maintenance

Setting, review, indexation or recovery: maintenance is calculated from each party's means and needs, and those figures have to be documented.

  • Division of matrimonial property

Dividing jointly owned assets, deciding who keeps the family home and what happens to the debts is separate work from the divorce itself.
